Acceptable Use Policy — Cumhub.ai

This acceptable use policy covers the products, services, and technologies (collectively, the "Products") provided by Cumhub.ai under any ongoing agreement. It is designed to protect us, our customers, and the Internet community from unethical, irresponsible, and illegal activity. Customers engaging in prohibited activities may face service suspension and account termination; in extreme cases we may report such customers to the relevant authorities. Fair use and customer accountability

We provide our facilities on the assumption that use will be "business as usual", as per our offer schedule. Excessive use may result in additional fees or capacity restrictions.

• We regard our customers as responsible for their own actions and for the actions of anyone using our Products with the customer's permission. This also applies to unauthorized use resulting from the customer's failure to implement reasonable security measures.
• By accepting Products from us, customers agree to ensure adherence to this policy on behalf of anyone using the Products as end users. Complaints regarding customers or their end-users will be forwarded to the nominated account contact.
• If a customer, end-user, or anyone using our Products on the customer's behalf violates this policy, we may terminate associated Products or the account, or take any remedial action we deem appropriate, without notice. To the extent permitted by law, no credit is available for service interruptions resulting from such violations.

Our Products must not be used to transmit, distribute, or store material in violation of applicable law, including:

• Material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization.
• Material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
• Sending spam or running unconfirmed messaging lists in violation of applicable laws and regulations.
• Harassment, hate speech, advocacy of racial or ethnic intolerance, and any activity intended to threaten, abuse, or discriminate against any group or individual.

Unethical, exploitative, and malicious activity

Our Products must not be used to advertise or distribute software designed to violate this policy, including facilitating spam, network sniffing, flooding, mail-bombing, or denial-of-service attacks.

Our Products must not be used to access accounts or resources without authorization (hacking, cracking, phreaking, etc.), or to intentionally introduce viruses or malicious code into our systems.

Other prohibited conduct includes: attempting to obtain services without payment; using our facilities to avoid payment to other providers; unauthorized access to customer data; interfering with other users' use of the service; and any violation of consumer protection laws or a person's privacy.

Copyright infringement and unauthorized material

Our Products must not be used to transmit, distribute, or store any material in violation of applicable law. The customer is solely responsible for all material they input, upload, disseminate, transmit, create, or publish through our Products, and for obtaining legal permission to use any works included in such material.

SPAM and unauthorized messaging

Our Products must not be used to send unsolicited bulk or commercial messages ("spam"), including soliciting customers from spam sent by other providers or collecting replies to such spam. Products must not be used for unconfirmed mailing or telephone lists: all lists must be "confirmed opt-in", with proof of permission available for the list's lifespan. Purchased email or phone lists intended for spam are prohibited. This policy applies to messages sent using our Products or from any network that refers recipients to a site hosted via our Products.

Unauthorized use of Cumhub.ai property

We prohibit the impersonation of Cumhub.ai, the representation of a significant business relationship with Cumhub.ai, or ownership of any Cumhub.ai property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage, or user trust.

This policy outlines a non-exclusive list of activities and intent we deem unacceptable and incompatible with our brand.

Prohibited content and entities

Publishing or transmitting content that incites violence, depicts child pornography, or threatens anyone's health and safety is strictly prohibited. Our Products may not be used by any person or entity involved in illegal gambling, terrorism, narcotics or arms trafficking, or the development or use of weapons of mass destruction.

Cumhub.ai records user activity and may report violations to the relevant authorities. Accounts involved in prohibited activity may be permanently suspended without notice.

Our company APEXON SOLUTIONS LTD (trading as Cumhub.ai) is registered at 128 City Road, London, United Kingdom, EC1V 2NX and operates in accordance with the laws of the United Kingdom. All matters related to the application of this policy are governed by the laws of the United Kingdom and relevant international standards.

About this policy

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version becomes effective on the earlier of: the date the customer uses our Products after publication, or 30 days after publication.
